MD Alloys will not pay any extraordinary or unanticipated duties that arise after order placement.

MD Alloys will take all reasonable steps to ensure product delivery to the customer within the agreed lead time. MD Alloys does not take accept responsibility for payment of compensation for late deliveries.

Delivery times apply from date of receipt of payment.

MD Alloys takes all reasonable precautions to ensure that products are delivered completely intact and undamaged. Damaged products must be returned with 30 days of arrival at the customer premises for a full refund. Transport and delivery of returned damaged products is the responsibility of the customer who pays all associated fees.  

Refunds will not be made unless the customer can prove within reason that physical, mechanical or compositional properties do not conform to their expressed order. At least 90% of intact unused alloy must be returned with the original packaging. Alloy must be returned within 30 days of arrival with the customer.

MD Alloys does not accept responsibility for injuries, acute or chronic diseases which may occur as a result of product use by the customer. MD Alloys expects all of its customers to be experts in the handling of metal alloys both in bar and powder form and to adopt all necessary health and safety precautions. This does not affect MD Alloy's liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

MD alloys does not accept any responsibility for disposal of waste or unwanted material.

You agree to indemnify, defend and hold harmless MD Alloys, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of the product or your breach of these terms and conditions.

If any part of these terms and conditions is unenforceable (including any provision excluding or limiting liability) the enforceability of any other part of these terms and conditions will not be affected and all other clauses will remain in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

The above terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between the customer and MD Alloys. Any waiver of any provision of these terms and conditions will be effective only if in writing and signed by a Director of MD Alloys.
